CBSE CTET February 2016: Last date for correction of online application is today
Today, January 4, 2016, is last date to make correction in online application for CBSE CTET February 2016.



The Central Board of Secondary Education, Delhi will be conducting the 9th edition of Central Teacher Eligibility Test (CTET) on February 21, 2016 (Sunday) for a candidate to be eligible for appointment as a teacher for class I to VIII. Candidates who have already applied online for this exam, have the facility to make correction in their online application. Today, January 4, 2016, is the last date to make these corrections online. While  making  corrections, candidates need to be extra careful as no correction in particulars, shall be entertained once due date is over.
No change will be accepted through offline mode i.e. through fax/application or by email etc. No correspondence in this regard will be entertained. Candidates also need to note that no request for any change in particulars will be accepted under any circumstances after the stipulated date for online correction is over.
The candidates whose candidature is not considered for CTET February 2016 on the CTET website due to non – receipt of fees may contact CTET office upto January 4, 2016 from 10:00 am to 5:00 pm along with proof of the payment of fees by any prescribed mode for considering their candidature for CTET February 2016 Examination, failing which the Board will not be responsible for non-issue of admit card to such candidate. Admit cards for the CBSE CTET 2016, will be available for download from January 25, 2016.
The CTET shall apply to schools of the Central Government (KVS, NVS, Central Tibetan Schools, etc.) and schools under the administrative control of UT’s of Chandigarh, Dadra & Nagar Haveli, Daman & Diu and Andaman & Nicobar Islands, Lakshadweep and NCT of Delhi. CTET may also apply to the unaided private schools, who may exercise the option of considering the CTET. Schools owned and managed by the State Government/local bodies and aided schools shall consider the TET conducted by the State Government.

CTET का शेड्यूल जारी, दो चरणों में होगा एग्जाम


सरकारी और प्राइवेट स्कूलों में शिक्षक की नौकरी के लिए अनिवार्य सीबीएसई सेंट्रल टीचर एलिजिबिलिटी टेस्ट(सीटीईटी) का सीबीएसई ने शेड्यूल जारी कर दिया है। 

प्रवक्ता अनुसार 21 फरवरी को सीटीईटी दो चरणों में होगा। पेपर-2(टीजीटी) सुबह 9.30 से 12 बजे और पेपर-1(जेबीटी) दोपहर 2 से 4.30 बजे तक होगा। परीक्षा के लिए 4 से 28 दिसंबर तक ऑनलाइन आवेदन स्वीकार किए जाएंगे।

इसके लिए सातवें वेतन आयोग ने एक चार्ट प्रस्तुत किया है 

नए फ्रेश ज्वाइन करने वालों को अपने ग्रेड पे में पहले सैल में लिखी सेलरी - बेसिक सेलरी होगी , उदाहरणार्थ 4600 ग्रेड पे की बेसिक सेलरी 44900 फिक्स होगी । 

अन्य कर्मियों को स्लेरी निम्न फॉर्मला से कैलकुलेट करनी होगी -

अपनी बेसिक + ग्रेड पे सेलरी को जोड़िये और उसका गुणा फिटमेंट फार्मूला पे  (उदाहरणार्थ 4600 ग्रेड पे का 2.62  है ) से कर दीजिये ,
उसके बाद जो सेलरी आये , टेबल में अपनी ग्रेड पे कॉलम में उसके बराबर या उसकी अगली पे को देखिये , यही आपकी नयी बेसिक सेलरी होगी 

Pay Fixation in the New Pay Structure
5.1.28 The fitment of each employee in the new pay matrix is proposed to be done by
multiplying his/her basic pay on the date of implementation by a factor of 2.57. The figure so
arrived at is to be located in the new pay matrix, in the level that corresponds to the
employee’s grade pay on the date of implementation, except in cases where the
Commission has recommended a change in the existing grade pay. If the identical figure is
not available in the given level, the next higher figure closest to it would be the new pay of the
concerned employee. A couple of examples are detailed below to make the process amply clear.
5.1.29 The pay in the new pay matrix is to be fixed in the following manner:
Step 1: Identify Basic Pay (Pay in the pay band plus Grade Pay) drawn by an employee as on
the date of implementation. This figure is ‘A’.
Step 2: Multiply ‘A’ with 2.57, round-off to the nearest rupee, and obtain result ‘B’.
Step 3: The figure so arrived at, i.e., ‘B’ or the next higher figure closest to it in the Level
assigned to his/her grade pay, will be the new pay in the new pay matrix. In case the value of
‘B’ is less than the starting pay of the Level, then the pay will be equal to the starting pay of
that level.


Example I
i. For example an employee H is presently drawing Basic Pay of ₹55,040 (Pay in the Pay
Band ₹46340 + Grade Pay ₹8700 = ₹55040). After multiplying ₹55,040 with 2.57, a
figure of ₹1,41,452.80 is arrived at. This is rounded off to ₹1,41,453.
ii. The level corresponding to GP 8700 is level 13, as may be seen from Table 4, which
gives the full correspondence between existing Grade Pay and the new Levels being
proposed.
iii. In the column for level 13, the figure closest to ₹1,41,453 is ₹1,41,600.
iv. Hence the pay of employee H will be fixed at ₹1,41,600 in level 13 in the new pay
matrix as shown below:



Example II
i. Take the case of an employee T in GP 4200, drawing pay of ₹20,000 in PB-2. The Basic
Pay is ₹24,200 (20,000+4200). If there was to be no change in T’s level the pay fixation
would have been as explained in Example I above. After multiplying by 2.57, the
amount fetched viz., ₹62,194 would have been located in Level 6 and T’s pay would
have been fixed in Level 6 at ₹62,200.
ii. However, assuming that the Commission has recommended that the post occupied by
T should be placed one level higher in GP 4600. T’s basic pay would then be ₹24,600
(20000 + 4600). Multiplying this by 2.57 would fetch ₹63,222.
iii. This value would have to be located in the matrix in Level 7 (the upgraded level of T).
iv. In the column for Level 7 ₹63,222 lies between 62200 and 64100. Accordingly, the pay
of T will be fixed in Level 7 at ₹64,100.

32. It is further clear  from the Scheme of the two Examinations, the CTET as conducted by the NCTE, and the Main Examination as was notified to be conducted by the respondent-KVS before the start of the selection procession, that the two are not on all fours with each other. This aspect had been most forcefully brought out by the learned counsel appearing for the applicants for the posts of TGT (Maths), who had pointed out that in the Table as reproduced in para-4/above, for the Main Examination for recruitment for the posts of TGT (Science) required Chemistry, Botany and Zoology, and for the posts TGT (Maths) required Maths with any two of the subjects like Physics/Chemistry/Electronics/Computer Science/Statistics, while the CTET combines the selection for the Science and Mathematics Teachers to be together. Therefore, passing of CTET can at best be termed to be a minimum qualification or a condition precedent, but not the sufficient qualification, and the respondents cannot be allowed to base their judgment regarding the selection of Teachers by downgrading the Educational standards from what was prescribed at the beginning of the selection process. Therefore, it is held that CTET could not have been and cannot be a substitute of the Main Examination already notified to be held as per Rule-8 (ii) of the Recruitment Advertisement. 

33. In the result, the interviews held from 12.03.2012 to 26.03.2012 by the respondent-KVS, only on the basis of the marks obtained by the candidates of the CTET, cannot be held to have been conducted within the notified Scheme as per the Recruitment Advertisement-cum-vacancy notification issued by the respondents at the beginning of the selection process in the Employment News of the week 30.10.2010 to 05.11.2010.  An examination which prescribes 60% or 50% etc. as the passing marks, but does not give due weightage to any higher marks obtained by candidates above that, and it is stated to be and meant to be only as a qualifying examination for appointment of Primary Teachers and Upper Primary Teachers, cannot provide the sole criteria of marks for selection of Trained Graduate Teachers (TGTs) in the respondent-KVS.

34. Accordingly, all the OAs are allowed, and the interviews held in March, 2012 are declared to be illegal. The respondents are directed to re-start the process of selection, by conducting the already notified Main Examination, allowing all the candidates who had applied for the relevant posts against the Recruitment Advertisement-cum-vacancy notification, and had passed the Preliminary Examination/Screening-Test conducted by the Respondent-KVS on 10.02.2011, and have also thereafter passed and qualified at the statutorily prescribed CTET held on 26.06.2011.  Only after the respective merit of the candidates is reflected through the marks obtained by them in the Main Examination conducted by the respondent-KVS, and fresh cut-off marks are determined for each Post-Code for calling the candidates for interviews, those interviews alone would be valid under the process of selection already initiated for being undertaken by the respondents.  There shall be no order as to costs.

इसी को देखते हुए के वी एस , एन वी एस और सभी केंद्रीय स्कूलों की भर्ती में टेट मार्क्स का वेटेज नहीं लिया जा रहा है , पोस्ट में नीचे केट (केंद्रीय प्रशासनिक न्याधिकरण) का निर्णय नीचे देख सकते हैं 


अब उत्तर प्रदेश में टेट का मामला सुप्रीम कोर्ट में है 
की क्या टेट परीक्षा सिर्फ पात्रता परीक्षा है , क्या इसके अंको का प्रयोग चयन में किया जा सकता है 

इलाहबाद हाई कोर्ट के तीन जजों के बेंच ने चयन में टेट मार्क्स इग्नोर नहीं करने को बोला है , देखिये -


एन सी टी ई ने कहा है कि -
चयन में टेट मार्क्स का वेटेज दिया जाना चाहिए और अभ्यर्थी टेट मार्क्स वृद्दि करने के लिए दोबारा टेट परीक्षा दे सकते हैं 


एक और बात सामने है की अलग अलग टेट परीक्षाओं के स्तर की तुलना कैसे हो सकती है सी टेट का परीक्षा परिणाम सामान्यत : दस प्रतिशत के नीचे रहा है 
और यू पी टेट 2011 में 45% रहा है । 
हालाँकि यू पी टेट 2011 में सभी कैंडिडेट्स को पूर्व में ही सूचित कर दिया था की यह परीक्षा ही शिक्षकों के चयन का आधार बनेगी और यह उत्तर प्रदेश सरकार की पहली टेट परीक्षा थी तो इसमें अलग अलग टेट परिणामो की तुलना का प्रश्न ही नहीं उठता । 
लेकिन आगे के नई भर्ती में के चयन में उत्तर प्रदेश सरकार सरकार ने सी टेट वालों को भी आवेदन की छूट दे दी और यू पी टेट 2013 भी हो गया , और इसके साथ ही उत्तर प्रदेश सरकार ने टेट को सिर्फ पात्रता परीक्षा माना । 

दुसरी तरफ 72825 शिक्षकों यू पी टेट 2011 परीक्षा के तहत मामला इलाहबाद हाई कोर्ट की डबल बेंच में चल रहा था , जहाँ की कोर्ट ने देखा कि चयन प्रक्रिया 
बीच में ही बदल दी गई थी तो इस सबको देख कर पुरानी चयन प्रक्रिया जो की एन सी टी ई के नियमो का पूर्णत पालन करती थी और विधि सम्मत थी को बहाल कर दिया , साथ ही 15 वां संसोधन जो की सिर्फ अकादमिक अंको से चयन प्रक्रिया का था उसे एन सी टी ई के नियमो के विपरीत पाते हुए अवैध घोषित कर दिया 

एक और मामला इलाहबाद हाई कोर्ट में थी की क्या टेट परीक्षा के बगैर शिक्षकों के भर्ती हो सकती है , उसमें लार्जर बेंच (तीन जजों के बेंच) ने  फैसला दिया -
टेट योग्यता  शिक्षक भर्ती के लिए परम  आवश्यक है और टेट परीक्षा के अंको को चयन में इग्नोर न किया जाए

एक और बात की तत्कालीन यू पी सरकार ने भी पिछली सरकार की सभी भर्तियां नियमो के आभाव में कोर्ट में लटकती ही रही हैं , वोट बैंक, आरक्षण इन सबके कारण इसकी कई नीतियों को कोर्ट से झटका भी लगा है ।
जब उत्तर प्रदेश लोक सेवा आयोग के चेयरमेन अनिल यादव अनिल यादव की भर्ती ही अवैध करार कर दी हाई कोर्ट ने तो सोच सकते हैं की ऐसे इंसान ने किस तरह की भर्तियों को अंजाम दिया होगा । 
पी सी एस अधिकारियों की भर्ती में तीन तीन लेवल पर आरक्षण - प्रीलिम्स , मेंस और इंटरवियु तीन चरणो में आरक्षण , मतलब भर्ती हुई नहीं आरक्षण हर लेवल पर दे दिया और इस प्रकार सामान्य वर्ग के गिने चुने उम्मीदवार ही अंतिम चरण अर्थात नियुक्ति में स्थान बना पाये , बाद में खुद उत्तर प्रदेश सरकार ने इस गलती को तीव्र विरोध के कारण दूर किया । 
लेकिन इसने यही कार्य 29334 जूनियर गणित विज्ञानं शिक्षकों की भर्ती में भी कर दिया , मतलब टेट आरक्षित वर्ग से पास करने वालों को भी 
सामान्य वर्ग में आवेदन / नियुक्ति की छूट दे दी , हालाँकि इलाहबाद हाई कोर्ट की अदालत ने टेट को पात्रता परीक्षा मानते
हुए सरकार की इस नीति को सही माना , लेकिन राजस्थान की हाई कोर्ट ने आरक्षित श्रेणी में टेट पास करने बालों को सिर्फ आरक्षित वर्ग की सीट पर आवेदन की अनुमति दी
मतलब नियम एक लेकिन अदालतों के फैसले अनेक

एक बार अंतिम निर्णायक लड़ाई सुप्रीम कोर्ट में 7 /8 दिसंबर 2015 को  तय होनी है की - टेट परीक्षा क्या है ?
पात्रता या फिर पात्रता+चयन में इसके अंको का आधार 

अगर इसके अंको का वेटेज लेना था जरूरी था या है तो जिन चयन प्रक्रियाओं में इसके अंको का वेटेज नहीं लिया मतलब ऐसे लाखों चयनित शिक्षकों के भविष्य'का क्या होगा 


और अगर इसके अंको का वेटेज नहीं लेना था तो एन सी टी ई गाइड लाइंस ने क्यों लिखा की अंक वृद्दि के लिए दोबारा परीक्षा दे सकते हो ,
क्यों बेरोजगारों को मूर्ख बना कर फीस वसूलते हो , उनका कीमती समय बर्बाद करते हो । उनका शोषण तो मत करो 

अब सुप्रीम कोर्ट से इस पर अंतिम फैसला हो जाएगा तो फिर सब स्पष्ट हो जाएगा , बेरोजगारों का खून पीने में कमी आ सकती है

It is further clear  from the Scheme of the two Examinations, the CTET as conducted by the NCTE, and the Main Examination as was notified to be conducted by the respondent-KVS before the start of the selection procession, that the two are not on all fours with each other. This aspect had been most forcefully brought out by the learned counsel appearing for the applicants for the posts of TGT (Maths), who had pointed out that in the Table as reproduced in para-4/above, for the Main Examination for recruitment for the posts of TGT (Science) required Chemistry, Botany and Zoology, and for the posts TGT (Maths) required Maths with any two of the subjects like Physics/Chemistry/Electronics/Computer Science/Statistics, while the CTET combines the selection for the Science and Mathematics Teachers to be together. Therefore, passing of CTET can at best be termed to be a minimum qualification or a condition precedent, but not the sufficient qualification, and the respondents cannot be allowed to base their judgment regarding the selection of Teachers by downgrading the Educational standards from what was prescribed at the beginning of the selection process. Therefore, it is held that CTET could not have been and cannot be a substitute of the Main Examination already notified to be held as per Rule-8 (ii) of the Recruitment Advertisement. 

33. In the result, the interviews held from 12.03.2012 to 26.03.2012 by the respondent-KVS, only on the basis of the marks obtained by the candidates of the CTET, cannot be held to have been conducted within the notified Scheme as per the Recruitment Advertisement-cum-vacancy notification issued by the respondents at the beginning of the selection process in the Employment News of the week 30.10.2010 to 05.11.2010.  An examination which prescribes 60% or 50% etc. as the passing marks, but does not give due weightage to any higher marks obtained by candidates above that, and it is stated to be and meant to be only as a qualifying examination for appointment of Primary Teachers and Upper Primary Teachers, cannot provide the sole criteria of marks for selection of Trained Graduate Teachers (TGTs) in the respondent-KVS.

34. Accordingly, all the OAs are allowed, and the interviews held in March, 2012 are declared to be illegal. If TET Pass Candidates are not available in sufficient number then minimum qualification (TET) can be relaxed.

हालाँकि केट एक अर्ध न्यायिक अदालत होती है और केंद्र सरकार के कर्मचारियों के प्रशासनिक मामलों को त्वरित रूप से निपटाने के लिए बनाई गई है । 
इसके जज क़्वासी जुडिशियल बॉडी यानि अर्ध सरकारी जज कहलाते हैं और इसीलिये फैसला देने वाले अपने आप को जज की जगह मेंबर लिखते हैं 
इनके फैसलों को ऊपरी अदालत अर्थात हाई कोर्ट में चुनौती दी जा सकती है , आज से कुछ साल पहले जब यह केस सामने आया था तो बड़े बड़े न्यूज़ पेपर ने 
खबर बेचने के लिये लिखा था की  - केंद्रीय न्यायिक प्राधिकरण ने टेट से छूट दे दी 

जबकि ये ट्राइब्यूनल / प्राधिकरण वास्तव में पूरी कोर्ट भी नहीं कहलाते , और कई बार हाई कोर्ट ने ही केट (केंद्रीय न्यायिक प्राधिकरण) को इसके कुछ निर्णय पर फटकार लगाई है ,हाई कोर्ट तो केंद्रीय सूचना आयोग को भी कई फटकार लगा चुका  है और इस आयोग को दण्डित भी कर चुका है । 
केंद्रीय सूचना आयोग भी अर्ध न्यायिक ट्राइब्यूनल है और हाई कोर्ट से नीचे आती है 

वास्तव में केंद्रीय न्यायिक प्राधिकरण का  ऑर्डर था  ->अगर टेट पास अभ्यर्थी पर्याप्त संख्या में उपलब्ध नहीं , तो टेट में छूट संभव

2. The grievance of the  applicant in the  present OA is against introduction of CTET qualification for engagement of  Resource Teachers on contract basis. Shri Ashok Aggarwal, learned counsel for applicant submitted that the respondents need Resource Teachers who could impart special education to disabled children in different schools of NCT of Delhi Government and requirement of such teachers was approximately 2400, while with the fresh qualification made essential for the post i.e. CTET, only about 146 candidates were found to be eligible to work as Resource Teacher on contract basis. 
3. On the other hand, Shri Vijay Pandita, learned counsel for respondents submitted that the applicants were appointed only in a project  where there is no need of more Resource Teachers. Relying upon the letter dated 11th February, 2011 of National Council for Teacher Education, he submitted that in terms of the provisions  of  sub-section 1 of  Section 23 of the  RTE Act, the National Council for  Teacher Education had issued notification dated 23.08.2010 laying the minimum qualification of  the persons eligible for appointment as teacher  for class I to VIII and one of the essential qualifications for a person to be eligible for appointment as a teacher in any of the schools referred to  in clause (n) of section 2 of the RTE Act is that he/she should have passed the Teacher Eligibility Test (TET). He also placed reliance on 199th  PAB meeting  dated 12.04.2013 to espouse his argument that the contractual appointment of the applicant was  only in a project. Finally he  referred to Judgment of the Hon ble Delhi High in W.P.(C) No.2544/2013 & CM Nos.4818-19/2013, Ruchika Arora & Ors. Vs. Union of India & Ors.  wherein the Hon ble Delhi High Court ruled that what qualification  should be required to be satisfied by a candidate need to be looked into by the  specialized  body and should not  be gone into by the court. Admittedly, the  said judgment was upheld by a DB of the Hon ble High Court.
4.    Rejoining the  submissions, Shri Ashok Aggarwal, learned counsel for the applicant referred to Section 23 (2) of Right to  Education Act and submitted that when the respondents are unable to  find sufficient number of trained teachers possessing minimum qualification  as provided     in    at      the  act   Section 23 (1), the       Central 
Government, if  necessary, by a notification could relax  the qualification required for appointment of   teachers. He also submitted that in terms of Section 25  & 26 of the Right of Children to Free and Compulsory Education Act, it is imperative  for the respondents to ensure that the  Pupil-Teacher Ratio  as specified under schedule is maintained.
5. We heard the counsel for the parties and perused the record.
6. As has been ruled by Delhi High Court in Ruchika Arora & Ors. Vs. Union of India & Ors (ibid), it is not for us to take a view that what qualification is required for a teacher to  become eligible for  a particular post.

Nevertheless, as has been provided in the Right of Children to  Free and Compulsory Education Act, 2009, the Central Government may relax the minimum qualification  for the post to have sufficient teachers to abide by the Section 25 & 26 of the  Act. Shri Ashok Agarwal,  learned counsel for the applicant specifically submitted that  sufficient number of  Resource Teachers should be available  with Government of  NCT of Delhi for the project in question.

In the circumstances, the OA is disposed of with direction to the  respondents to assess the requirement of Resource Teachers in the project in question and if  it is found that sufficient eligible teachers are not available  to discharge the function  as Resource Teacher  in the project on  contract basis, they would take up the matter to relax the condition of minimum qualification in terms of Section 23 (2). They will examine whether there is any need to appoint  Resource Teachers by relaxing the minimum  qualification in the case of the applicant. It is made clear that if there is no teacher required in the stream of Resource Teacher, it would not be mandatory to respondents to enhance  the requirement to accommodate the  applicants. Nevertheless,        while                doing             the         aforesaid        exercise, they would  Keep in view  Sections 25 & 26 of the Right of Children to Free and Compulsory Education Act, 2009. 
OA stands disposed of.
