रांची: झारखंड में हाईकोर्ट ने राज्य में चल रही हाईस्कूल शिक्षक नियुक्ति प्रक्रिया का विज्ञापन रद्द कर दिया है। न्यायमूर्ति एस चंद्रशेखर की बेंच ने हरी शर्मा और अन्य की याचिका पर सुनवाई के बाद गुरुवार को यह आदेश सुनाया।

याचिका में कहा गया था कि हाईस्कूल में शिक्षक नियुक्ति के लिए निकाले गए विज्ञापन में राजनीति विज्ञान और इतिहास विषय में स्नातक उत्तीर्ण छात्रों को ही आवेदन करने का प्रावधान किया गया था जबकि नागरिक शास्त्र विषय के लिए भी रिक्तियां दिखाई गई थीं। अदालत ने इसको सही नहीं माना और पूरा विज्ञापन ही रद्द करने का आदेश दिया। हाईकोर्ट ने अपने आदेश में विज्ञापन के इस प्रावधान को गलत और भेदभावपूर्ण करार दिया है।

अदालत ने राज्य कर्मचारी चयन आयोग को 2015 की नियमावली और हाईकोर्ट के आदेश को ध्यान में रखते हुए फिर से विज्ञापन निकालने का आदेश दिया। विदित हो कि हाईस्कूलों में करीब 17,900 शिक्षकों की बहाली के लिए विज्ञापन निकाला गया था।

अदालत ने अपने फैसले में यह भी कहा है कि पूर्व में आवेदन करने वाले छात्रों को दुबारा आवेदन नहीं देना होगा, नये विज्ञापन में उम्र सीमा की गणना पुराने के अनुसार ही की जाएगी ताकि कोई भी अभ्यर्थी आवेदन देने से वंचित न रह जाए। इसी प्रकार गणित विषय के साथ भौतिकी और रसायन के विषय के कांबिनेशन को अदालत ने गलत नहीं माना और इस संबंध में दायर दो याचिकाओ को खारिज कर दिया।

Ranchi: The Jharkhand Academic Council announced that the teachers' eligibility test will be held on November 20 after a gap of four years.
The application form for the Jharkhand Teachers' Eligibility Test (JTET) will have to be filled from September 8 to 20. JAC chairman Arvind Pratap Singh said, "The examination fees for general category applicants is Rs 500 while for the SC/STs it is Rs 250."
To clear the JTET, a general category student has to score a minimum of 60% marks, while the SC/ST and OBC students need at least 52%. The question paper will be set both in English and Hindi and it will have only objective type questions.
The two-and-a-half-hour examination will have 150 questions for 150 marks.
For recruitment of Urdu assistant teachers, the questions will be asked in Urdu and English, while for Hindi assistant teacher questions will be set in Hindi and English.
Those clearing the examination will be recruited as teachers in primary and middle schools of the state.
However,t he declaration of dates has once again raised protests from those who passed the first JTET examination in 2012 but are yet to be recruited.
Shamim Ali, a protester, said, "About 64,000 applicants cleared the first JTET, of which only 17,000 were recruited. Also, about 10,000 of those candidates who are yet to be selected are those whose age limit for recruitment has already crossed."
"In such a situation, how can government think of conducting another examination?" he asked.
The JTET pass candidates have planned to take out a protest march and gherao the CM's house on September 6.

नौ साल बाद ली जायेगी झारखंड पात्रता परीक्षा

रांची: राज्य में झारखंड पात्रता परीक्षा (जेट) की प्रक्रिया जल्द शुरू होगी. उच्च एवं तकनीकी शिक्षा विभाग ने इस संबंध में झारखंड लोक सेवा आयोग को पत्र भेज दिया है.

नौ साल बाद राज्य में दूसरी पात्रता परीक्षा होगी. विभाग द्वारा मंगलवार को इस आशय का पत्र जेपीएससी को भेजा गया. झारखंड लोक सेवा आयोग अब परीक्षा के लिए आवेदन आमंत्रित करेगा. झारखंड पात्रता परीक्षा के बाद राज्य के कॉलेजाें में शिक्षकों की नियुक्ति प्रक्रिया शुरू होगी. शिक्षकों की नियुक्ति को लेकर झारखंड राज्य विश्वविद्यालय विधेयक-2015 में संशोधन को इस वर्ष सरकार से स्वीकृति मिल गयी है. राज्य भर के विश्वविद्यालय के कॉलेजों में शिक्षकों के लगभग 1900 पद रिक्त हैं. झारखंड पात्रता परीक्षा होने के बाद इन पदों पर नियुक्ति प्रक्रिया शुरू होगी.

राज्य गठन के बाद मात्र एक बार कॉलेजों में शिक्षकों की नियुक्ति हुई है. वर्ष 2008 में कॉलेजों में लगभग 750 शिक्षकों की नियुक्ति हुई थी. कॉलेजों में शिक्षकों के आधे से अधिक पद रिक्त हैं. शिक्षकों की कमी के कारण विवि में पठन-पाठन प्रभावित हो रहा है. कॉलेजों में शिक्षक नियुक्ति के लिए प्रत्येक वर्ष योग्यता परीक्षा आयोजित करने का प्रावधान अधिनियम में किया गया है. राज्य गठन के बाद से अब तक मात्र एक बाद झारखंड पात्रता परीक्षा हुई है.झारखंड में वर्ष 2007 में झारखंड पात्रता परीक्षा हुई थी. परीक्षा में गड़बड़ी की शिकायत सामने आने के बाद इसकी जांच सीबीआइ ने की थी. इसके बाद से राज्य में पात्रता परीक्षा नहीं हुई है,जबकि प्रावधान के अनुरूप प्रति वर्ष पात्रता परीक्षा होनी चाहिए.

विवि ने क्लियर किया आरक्षण रोस्टर
कॉलेजों में शिक्षकों की नियुक्ति प्रक्रिया शुरू करने के लिए विश्वविद्यालयों द्वारा आरक्षण रोस्टर क्लियर करने का काम पूरा कर लिया गया है. रांची विवि को छोड़कर राज्य के सभी विवि ने आरक्षण रोस्टर क्लियर कर रिपोर्ट विभाग को भेज दिया है. विनोबा भावे विश्वविद्यालय, कोल्हान विश्वविद्यालय, नीलांबर-पीतांबर विश्वविद्यालय व सिदो-कान्हू विवि की रिपोर्ट विभाग को मिल गयी है. पिछले दिनों उच्च एवं तकनीकी शिक्षा विभाग के सचिव ने विवि को जल्द-से-जल्द रोस्टर क्लियर करने को कहा था. सभी विवि को एक सप्ताह के अंदर रिपोर्ट भेजने को कहा गया था.

झारखंड पात्रता परीक्षा की प्रक्रिया जल्द शुरू होगी. इसके लिए उच्च एवं तकनीकी शिक्षा विभाग द्वारा झारखंड लोक सेवा आयोग को पत्र लिखा गया है. आयोग से जल्द-से-जल्द परीक्षा प्रक्रिया शुरू करने का आग्रह किया गया है. राज्य के विवि में शिक्षकों की नियुक्ति के लिए झारखंड राज्य विवि अधिनियम में संशोधन की प्रक्रिया भी पूरी हो गयी है.

झारखंड की रघुवर सरकार टेट पास अभ्यर्थियों को ठगने के लिए सारी भूमिका बना ली है. वर्षों से नौकरी का इंतजार कर रहे टेट पास अभ्यर्थी एक बार फिर आंदोलन के मूड में हैं. इधर,शिक्षा मंत्री का कहना है कि सभी की नौकरी कहीं नहीं होती है.

टेट पास अभ्यर्थी संघ के नेता उग्र आंदोलन के मूड में हैं. छात्र नेता मनोज कुमार कहते हैं कि सरकार अगर इस तरह वादा खिलाफ करेगी तो हरियाणा के अंदाज में ही आंदोलन करेंगे.

क्या है मामला

झारखंड सरकार ने शिक्षक नियुक्ति के लिए टेट की परीक्षा का आयोजन किया था. इसमें लगभग 65 हजार लोग सफल हुए. इनमें पारा शिक्षक भी शामिल हुए. और सामान्य अभ्यर्थी भी थे. अभी सिर्फ कुछ हजार की नियुक्ति हो पायी है. अधिकांश लोग नौकरी की बाट जोह रहे हैं.

हाल में टेट पास अभ्यर्थियों को सरकार की ओर से सभी लोगों के नियोजन का आश्वासन दिया गया था. लेकिन अब सरकार वादा खिलाफी कर रही है. सिर्फ पांच हजार शिक्षकों के नियुक्ति भविष्य में करने की मंशा है.

बजट सत्र में गर्माया मुद्दा

झारखंड विधानसभा के चालू सत्र में यह मामला सत्ता पक्ष के सदस्य ने उठाया. दूसरे दलों के विधायक भी इनके साथ हैं. 2012 में यह रिजल्ट आया था. टेट पास अभ्यर्थियों की उम्र भी खत्म हो रही है. सरकार को इनकी जरा भी चिंता नहीं है. भाजपा विधायक अनंत ओझा भी मानते हैं कि ऐसे में सरकार पर वादाखिलाफी का आरोप सही लगता है.

उधर, शिक्षा मंत्री नीरा यादव कहती हैं कि कोशिश हो रही है कि नियुक्ति हो जाए. लेकिन शिक्षा मंत्री सभी की नियुक्त से साफ मुकर जाती हैं और कहती हैं कि सौ प्रतिशत रिजल्ट तो कहीं नहीं आता.

बहरहाल, झारखंड सरकार के इस रूख से टेट पास अभ्यर्थी काफी खफा है. राज्य में शिक्षकों के 80 हजार पद रिक्त हैं. फिर भी सरकार बेरूखी के साथ इनके साथ व्यवहार कर रही है. लिहाजा,इनका आंदोलन फिर से शुरू हो सकता है.

रांची : शिक्षक प्रशिक्षण प्राप्त छात्र-छात्राओं को दूसरी शिक्षक पात्रता परीक्षा (टेट) के लिए अभी और इंतजार करना होगा। स्कूली शिक्षा एवं साक्षरता विभाग ने अभी तक झारखंड एकेडमिक कौंसिल को परीक्षा आयोजित करने को लेकर अनुशंसा नहीं भेजी है। आगामी वित्तीय वर्ष के बजट पारित होने के बाद ही परीक्षा की अनुशंसा भेजे जाने की उम्मीद है।

अभी तक दूसरी शिक्षक पात्रता परीक्षा समय सीमा को लेकर फंसी थी। विभाग में इस बात को लेकर असमंजस की स्थिति थी कि यह परीक्षा डेढ़ घंटे की होगी या ढाई घंटे की। इस बाबत राष्ट्रीय अध्यापक शिक्षा परिषद (एनसीटीई) से लगभग एक माह पूर्व ही दिशा-निर्देश मंगाया गया, जिसमें यह परीक्षा ढाई घंटे की लेने की बात कही गई। इससे पहले एनसीटीई से दिशा-निर्देश लेने में ही तीन माह लग गए थे।

उल्लेखनीय है कि 2010 में एनसीटीई द्वारा रेगुलेशन जारी होने के बाद भी राज्य में पहली शिक्षक पात्रता परीक्षा 2012-13 में आयोजित की गई थी। इसके बाद यह परीक्षा नहीं हो सकी है, जबकि रेगुलेशन में यह परीक्षा साल में अधिकतम दो बार आयोजित किए जाने का प्रावधान है। इस प्रावधान के तहत कई राज्यों में यह परीक्षा दो से सात बार तक आयोजित की जा चुकी है।

पहली परीक्षा में लगे थे तीन साल

राज्य सरकार ने पहली शिक्षक पात्रता परीक्षा पूरी कराने में भी तीन साल लगाए थे। विभाग ने शुरू में एनसीटीई के रेगुलेशन को नजरअंदाज करते हुए शिक्षक पात्रता परीक्षा आयोजित न कराकर 2010 में सीधे प्राथमिक शिक्षक नियुक्ति की अनुशंसा जैक को भेज दी थी। जैक ने इस आलोक में नियुक्तिप्रक्रिया शुरू भी कर दी। इस बीच केंद्र के हस्तक्षेप के बाद विभाग ने आनन-फानन में नियुक्ति परीक्षा को ही शिक्षक पात्रता परीक्षा घोषित कर दी, जबकि परीक्षा के पैटर्न में कोई बदलाव नहीं किया। परीक्षा लेकर परिणाम भी जारी कर दिया। बाद में यह मामला झारखंड हाई कोर्ट में गया। कोर्ट ने नियुक्तिपरीक्षा परिणाम को रद करते हुए पहले शिक्षक पात्रता परीक्षा आयोजित करने का आदेश दिया।

रांची. झारखंड में लगभग 18 हजार हाई स्कूल शिक्षकों की नियुक्ति की जाएगी. खबरों के मुताबिक लगभग दो साल से विभिन्न विभागों में घूम रहे नियमावली-2015 प्रस्ताव को कैबिनेट द्वारा गठन की मंजूरी दे दी गई जिसके तहत राज्य में लगभग 18 हजार हाई स्कूल शिक्षकों की भर्ती का रास्ता साफ हो गया है.

झारखंड सरकारी माध्यमिक विद्यालय शिक्षक एवं शिक्षकेतर कर्मचारी नियुक्ति एवं सेवा शर्त नियमावली-2015 के तहत अब कई कोटि के हाई स्कूलों में शिक्षकों की नियुक्ति के लिए अनुशंसा झारखंड कर्मचारी चयन आयोग को भेजी जा सकेगी.

बता दें कि अभी इन स्कूलों में सिर्फ 10 प्रतिशत शिक्षकों के बल पर पाठन चल रहा है.

By   way   of   I.A.   No.   6112   of   2013   petitioner   seeks   to   incorporate additional prayer for quashing of order dated 6.9.2012 passed by the Deputy Commissioner, Jamtara whereby the claim of the petitioner for appointment as Para Teacher has been rejected. Petitioner has approached this Court for directing   the   respondents   to   issue   appointment   letter   for   the   post   of   Para
Teacher in Upgraded Primary School, Benagoria, Jamtara on account of his claim that he has been selected by the Village Education Committee as well as Aam Sabha on 29.2.2012 itself. He has also prayed for direction upon the respondents   to   dispose   of   his   representation   pending   before   the   Deputy Commissioner, Jamtara.
In   such   circumstances,   the   proposed   amendment   is permitted to be incorporated in the main writ petition as the order has been passed on the representation of the petitioner rejecting his claim.

The grievance of the petitioner as aforesaid in the main writ application was for issuance of appointment letter for the post of Para Teacher in the upgraded school Benagoria, Jamtara on the strength of his claim   that   he   was   selected   by the   Village   Education   Committee   and   Aam
Sabha on 29.2.2012. In view of the new amendment by way of instant order,
the order of rejection passed by the Deputy Commissioner, Jamtara dated 6.9.2012 has also been challenged by the petitoner. Learned counsel for the petitioner   submits   that   petitioner   possessed   the   qualification   of   M.A/B.Ed. and has the necessary residential as well as   caste   certificate   for   being considered   for such -2-
appointment in the school in question as Para Teacher. It is submitted that the Village Education Committee considered the claim of several such candidates   and   one   Kumari   Mithurani   Mandal   was   recommended.   She however expressed her inability to join the   said post and   in   her place   the petitioner was selected for appointment as Para Teacher as is evident from
the proceedings of the Aam Sabha held on 29.2.2012 which is annexed as Annexure-4 to the writ petition. It is submitted that the respondents however have   chosen   to   deny   him   such   appointment,   therefore,   he   had   made representation   before   the   Deputy   Commissioner,   Jamtara,   which   however has been arbitrarily rejected .
Learned counsel for the respondent- State submits that after   coming   into   force   of   the   Right   of   Children   of   Free   and   Compulsory Education(R.T.E.) Act, 2009 for appointment to the post of Para Teacher the requirement   of Teachers Eligibility Test    is mandatory which   the   petitioner has   not   obtained.     It   is   further   submitted   that   the   Deputy   Commissioner,
Jamtara   after   hearing   the   petitioner   as   well   as   other   parties   including   the
Block Development Officer and Block Education Extention Officer and after going through the proceeding register found overwriting and tampering in the proceeding   which   led   him   to   the   conclusion   that   the   whole   exercise   was dubious   in   nature   in   which   petitioner   was   recommended   by   the   Village Education   Committee.   In   such   circumstances,   the   Deputy   Commissioner, Jamtara has directed to hold a fresh exercise in terms of the direction issued
by the Secretary, Human Resource Development Department, Government of Jharkhand, Ranchi as contained in letter no. 1234 dated 20.6.2012   for appointment   of   Para   Teacher   in   the   said   school.   No   rejoinder   to   the   said counter affidavit has been filed by the petitioner.
I have heard counsel for   the parties and gone through the relevant materials on record including the impugned order. It is apparent from the averments made in the writ petition as also on perusal of the order passed   by the   Deputy   Commissioner,   Jamtara   that   the   proceeding   of   the
Village   Education      Committee,   which   the   petitioner   claims   to   have
recommended his -3-
name     for     appointment   as   Para   Teacher,   has   been   found   to   be tampered   and   suffered   from   overwriting   making   dubious   in   nature   by   the Deputy   Commissioner,   Jamtara.   It   however   also   appears   that   for appointment as Para Teacher there is requirement of passing the Teachers Eligibility Test(TET) which obviously the petitioner has not passed at the time
selection was made. The documents which are relied upon by the petitioner i.e. the proceeding of the Village Education Committee is itself been doubted by the Deputy Commissioner after hearing the petitioner as well as Officials of the Block. That was also the reason that the Block Education Committee did   not   accord   approval   of   the   proceeding   of   recommendation   of   the
petitioner by the Village Education Committee.
In   that   view   of   the   mater,   this   Court   is   not   inclined   to exercise its discretionary jurisdiction to direct the respondents to appoint the petitioner   on   the   post   of   Para   Teacher   in   the   school   in   question   and   no interference is required in the impugned order. Accordingly, the writ petition is dismissed.

#रांची #झारखंड टेट पास अभ्यर्थियों ने एक बार फिर आंदोलन की धमकी दी है. रविवार को मोराबादी स्थित दादा-दादी पार्क में आयोजित बैठक में अभ्यर्थियों ने सरकार के उस फैसले पर कड़ी आपत्ति जताई जिसमें शिक्षक नियुक्ति के लिए दूसरी सूची जारी नहीं किए जाने की बात कही गई है.

शिक्षा मंत्री नीरा यादव के बयान पर नाराजगी जताते हुए टेट पास अभ्यर्थियो ने कहा कि सरकार शिक्षकों की नियुक्ति करना नहीं चाहती है, जिसके खिलाफ 21 मई से राजभवन के समक्ष आमरण अनशन किया जायेगा वहीं 26 मई को मुख्यमंत्री आवास का घेराव किया जायेगा.

महासंघ के संयोजक बजरंग प्रसाद ने न्यूज 18 से बात करते हुए कहा कि सरकार यदि रिक्त पड़े शेष 15 हजार शिक्षकों की नियुक्ति नहीं करती है तो आंदोलन को और भी उग्र रुप दिया जायेगा.

गौरतलब है कि कई दिनों तक राजभवन के समक्ष चल रहे अनशन को शिक्षा मंत्री नीरा यादव के आश्वासन के बाद तोड़ा गया था मगर उसके बाद सरकार अपने आस्वासन पर कायम नहीं रही और नियमावली का हवाला देते हुए शिक्षक नियुक्ति की चल रही प्रक्रिया में दूसरी लिस्ट जारी नहीं होने की बात कह टेट पास अभ्यर्थियों के उम्मीदों पर पानी फेर दिया जिससे टेट में सफल हजारों अभ्यर्थी खासे नाराज हैं.

This Letters Patent Appeal is preferred against the order dated 12.11.2013 passed in W.P.(S) No.7680 of 2012, whereby the writ petition of the appellant, seeking for direction for appointment as Para Teacher was dismissed.
2.The case of the appellant is that the appellant had applied for selection on the post of Para Teacher in the Upgraded Primary School, Benagoria on 28.2.2012 along with all certificates. Pursuant to the letter no.188   dated   22.2.2012   issued   by   the   District   Superintendent   of Education, Jamtara, a General Body meeting (AAM SABHA)
was held on 29.2.2012   under   the   Chairmanship   of   Shri   Kalipada   Hembrom   for
selection of Para Teacher in Upgraded Primary School, Benagoria. For the post of Para Teacher, total nine applicants had applied and out of which the appellant was selected and recommended. Initially one Kumari Mithu Rani Mandal was to be selected but due to her unwillingness for being
appointed as Para Teacher, the appellant was selected. When the Village Education   Committee   recommended   the   name   of   the   appellant   for approval on 1.8.2012, the appellant’s name was not approved by the Block Education Committee. The appellant also
made representation before the Deputy Commissioner, Jamtara requesting for his selection for
the post of Para Teacher. When no action was taken, the appellant filed W.P.(S) No. 7680 of 2012 for his appointment to the post of Para Teacher. During the pendency of t
he writ petition, the Deputy Commissioner, Jamtara vide order dated 6.9.2012 rejected the representation of the appellant, on the ground that there was over -
writing on the proceeding register of Village Education Committee and also in view of the fact that
the procedure for appointment of Para Teacher has been changed.
This fact was brought on record by way of filing one I.A. and also challenged
the order dated 06.09.2012.
The writ petition was finally dismissed on 12.11.2013 observing that the documents relied upon by the appellant is doubtful. It was further observed that for appointment as Para Teacher,
there is requirement for passing Teacher Eligibility Test, which obviously the appellant has not passed.
3.Being aggrieved by the dismissal of the writ petition, the appellant has filed this Letters Patent Appeal.
The learned counsel for the appellant submitted that the learned Single Judge failed to appreciate that the selection of the appellant on the post of Para Teacher was made by duly
constituted   Village   Education   Committee   in   its   meeting   held   on 29.02.2012 and the said meeting was held in a transparent manner. It is further   submitted   that   in   the   said   meeting   of   Village   Education Committee one lady candidate Kumari Mithu Rani Mandal and the
appellant was finally selected and only due to the unwillingness of the lady candidate Kumari Mithu Rani Mandal, the name of the appellant was finally recommended. The learned counsel further submitted that the appellant possesses higher educational qualification of M.A./M.Sc., B.Ed.
and on that basis his name was recommended by the Village Education Committee and while so the learned Single ought to have quashed the order dated 06.09.2012
passed by the Deputy Commissioner, Jamtara rejecting the representation of the appellant.
4.The   learned   counsel   for   the   respondent - State   of   Jharkhand   has
submitted that even though the Village Education Committee was alleged to have
recommended the name of the appellant on 29.02.2012, the same was forwarded by the Village Education Committee only on 01.08.2012 which was received in the office of the Block Education Committee only on 02.08.2012.
It is further submitted that in the meanwhile the Ministry of Human Resource   Development   Department   of   School   Education   and   Literacy, Government of India has issued a letter contained in D.O.No. 3-3/2012-EE-4 dated 07.05.2012 making it clear that only those persons who passed the Teacher Eligibility Test may be appointed as teachers for Class I to VIII
including contractual/para teachers. It was submitted that pursuant to the said notification, the Human Resource Development Department, State of Jharkhand has also issued letter No.JEPC/SSA/12/102/2010/1253 dated 25.06.2012 making it crystal clear that the selection of
Para Teacher shall be pursuant to provisions of R.T.E. Act, 2009 and the applicant for Para Teacher
must have passed Teacher Eligibility Test. It is further submitted that since the recommendation of the appellant was forwarded for approval to the Block Education Committee, Nala on ly on 02.08.2012 and the appellant having not passed Teacher Eligibility Test , the selection of the appellant was not approved and the learned Single Judge rightly dismissed the writ petition.
5.Even though the Village Education Committee has recommended thename of the appellant on 29.02.2012, the same was forwarded for approval to Block Education Committee only on 01
.08.2012. In the meanwhile, the Ministry of Human Resource Development Department of School Education and Literacy, Government of India vide letter contained in D.O. No.3-
3/2012-EE-4 dated 07.05.2012 made it clear that recruitment of teachers including contractual/para teachers, who have not qualified the TET would violate the provisions under the Right of Children of Free and Compulsory Education (RTE) Act, 2009. It was also clarified that it is
a binding and mandatory requirement under the RTE Act that only those persons who pass the TET may be appointed as teachers for Classes I to VIII. It was also mentioned in the said letter that every State is statutorily required to comply with this requirement and violation
of it may not stand the test of law. It also appears that in furtherance of the direction of Government of India, the Principal Secretary, Human Resources Development Department
-cum-State Project Director, Jharkhand State Education Project Council, Ranchi issued letter
No.JEPC/SSA/12/102/2010/1253 dated 25.06.2012 making it clear that selection of
Para Teacher shall be pursuant to the provisions of RTE Act, 2009 and the applicant must
have passed Teacher Eligibility Test . Even though the appellant is said to have higher qualification, since the appellant has   not   passed   the   Teacher   Eligibility   Test,
which   is   the   mandatory requirement, the recommendation of the Village Education Committe
e was not approved by the Block Education Committee. In view of the mandatory
requirement of passing TET as per the notification issued by the Ministry of Human Resource Development Department of School Education and Literacy, Government of India (07.05.20
12) and the subsequent notification issued by the State of Jharkhand (25.06.2012), the appellant cannot seek for a direction upon the respondents to consider him for appointment as para
teacher.
6. We do not find any reason warranting interference in the order of the learned Single Judge and this Letters Patent Appeal is dismissed.
If the appellant has subsequently qualified in Teacher Eligibility Test, the appellant is at liberty to participate in the subsequent selection, if any, either as a regular teacher or Para Teacher.
